Terms of Use

I.The agreement

These Terms of Use ("Terms") are a legal agreement between you and Legaryn LLC, a North Carolina limited liability company and the developer of Legaryn: Mythic Legends ("Legaryn", "we", "us"). They cover the Legaryn app, its online features, and legaryn.com (together, the "Game"). By downloading, installing or playing the Game, you agree to these Terms and our Privacy Policy. If you don't agree, please don't play.

II.Who can play

You must be 18 or older, or the age of adulthood where you live if that is higher. Before playing, every player confirms in the game that they are 18 or older and accepts the Code of the Realm, our zero-tolerance rules for player content.

You can't play if you've been banned from the Game before, or if the law where you live doesn't allow it.

III.Your account

• When you first play, we create a guest account on your device. Link Google or Apple in Settings to keep your progress safe. If a guest account is lost (for example, the app is deleted or the phone is reset), we may not be able to recover it.
• You're responsible for everything that happens on your account. Keep your sign-in secure.
• Your account is personal. You can't sell, trade, share, give away or buy an account.
• Your Warlord name and alliance name must follow the Code of Conduct. We may change a name that breaks it.

IV.Your license to play

We give you a personal, limited, non-exclusive, non-transferable, revocable license to download and play the Game for your own non-commercial entertainment, on a device you own or control and as allowed by the app store you got it from. The Game is licensed, not sold. You may not copy, change, reverse-engineer, decompile, resell, rent, or make derivative works from the Game, except where the law says you must be allowed to.

V.Virtual items and purchases

• What you're buying. The Game includes virtual items such as gems, summon scrolls, passes, cosmetics and other content ("Virtual Items"). Some can be earned by playing, and some can be bought with real money. When you get a Virtual Item, you receive a limited license to use it in the Game. You don't own it.
• No cash value. Virtual Items have no real-world value. They can't be exchanged for money, sold, traded, or moved between accounts, except where the Game itself allows it (for example, gifting inside an alliance).
• Payments. All purchases go through the Apple App Store or Google Play and follow their payment terms. Prices are shown in the Game before you buy and may change.
• Subscriptions and passes. If we offer an auto-renewing subscription, the price, length and what you get will be shown before you buy. It renews automatically unless you cancel at least 24 hours before the end of the current period, in your Apple or Google account settings. Deleting the app doesn't cancel it.
• Restoring purchases. One-time unlocks can be restored with Restore Purchases in the store. Used consumables, such as spent gems, can't be restored.
• Refunds. Except where the law requires, purchases are final. Refund requests go to Apple (reportaproblem.apple.com) or Google Play. If a refund is given or a payment is reversed, we may remove the matching Virtual Items, which can make your balance go below zero.
• EU and UK players. Digital content is delivered straight away when you buy it. By completing a purchase, you agree to immediate delivery and acknowledge that you lose your 14-day right of withdrawal once delivery starts. This doesn't affect your rights if an item is faulty or not delivered.
• Loss of items. Virtual Items may be lost if you delete your account, if your account is banned for breaking these Terms, or if the Game shuts down. If we ever close the Game, we'll give at least 60 days' notice in the Game and stop selling Virtual Items first.
• Mistakes. If Virtual Items are given in error (for example, through a bug or exploit), we may correct the balance.

VI.Summons and random rewards

Some features give random rewards, such as summons. The odds of each result, and any guarantee (such as a pity counter), are shown in the Game on the Summon screen under Odds & Guarantees before you summon. Each summon is independent unless a guarantee says otherwise. Summons can be done with items earned by playing.

VII.Code of conduct

Warlords fight hard but play fair. You agree not to:

• Post or send anything hateful, racist, sexist, homophobic or otherwise discriminatory, or anything that harasses, bullies, threatens or encourages self-harm.
• Post sexual, obscene or graphic violent content, or anything illegal.
• Pretend to be another person, a Legaryn team member, or a moderator.
• Share anyone's personal information, including your own, such as real names, addresses, phone numbers or photos.
• Spam, advertise, phish, scam, or offer to buy or sell accounts, items or services for real money.
• Use cheats, bots, macros, mods, hacks or any unauthorised software, or exploit bugs to gain an advantage. Please report bugs to us instead.
• Attack, overload or interfere with our servers, or try to access accounts or data that aren't yours.
• Use multiple accounts to boost, farm or manipulate wars, leaderboards, bounties or rewards.
• Break any law while using the Game.

VIII.Chat and player content

• Zero tolerance. Legaryn has zero tolerance for objectionable content and abusive players. No hate, harassment, real-world threats, sexual content, encouraging self-harm, or sharing anyone's personal details. Content that breaks these rules is removed, and players who break them are banned.
• The Code of the Realm. Every player accepts these rules, and confirms they are 18 or older, in the game before playing. Players must link an Apple or Google account before they can post anything other players see.
• Tools for you. Tap … on any message, post, taunt, alliance text or player (or press and hold) to report, hide, block or, for your own content, delete. Blocking hides everything from that player and stops their messages, invites and friend requests. You can also report or hide another player's profile picture.
• Filtering. Slurs, hate, sexual content, threats, self-harm encouragement and personal contact details are blocked automatically, and swearing is hidden. Filters aren't perfect, so please report anything that gets through.
• Profile pictures. Gravatar pictures are optional, need a linked account, and are shown only if rated G. Reported pictures can be removed by our moderators.
• Reports. We review reports and act on objectionable content within 24 hours, by removing the content and suspending or banning the player who posted it. Urgent concerns: support@legaryn.com.
• Your content. You keep any rights you have in what you post, such as chat messages, names and alliance mottos. You give us a worldwide, free, non-exclusive license to host, show, store and use it to run and promote the Game. You're responsible for what you post.
• No guarantee. Other players' content isn't ours and doesn't reflect our views. We may remove any content at any time.

IX.Suspensions and bans

If you break these Terms, we may warn you, remove content, mute you, reset progress or items gained unfairly, or suspend or permanently ban your account and devices. Depending on how serious it is, this may happen without warning. Banned players lose access to their Virtual Items with no refund, except where the law requires one. If you think we made a mistake, email support@legaryn.com and we'll take another look.

X.Changes to the game

Legaryn is a live game. We may update, balance, add or remove features, beasts, items, events and rewards, and we may need to take servers down for maintenance. You may need to install updates to keep playing. We'll try to give notice of major changes.

XI.Ownership

The Game, including its name, logo, artwork, beasts, story, music, sounds and code, belongs to us or our licensors and is protected by copyright, trademark and other laws. Except for the license in section IV, these Terms don't give you any rights to it. Ideas or feedback you send us may be used freely, without payment to you.

XII.Health warning

The Game contains flashing lights and fast-moving effects. A small number of people may have seizures when exposed to them, even without a history of epilepsy. If you feel dizzy or unwell, or notice twitching, stop playing and see a doctor. Reduce Visual Intensity in Settings tones down these effects. Take regular breaks.

XIII.Third-party services

The Game uses services from others, such as Apple, Google, Supabase, RevenueCat and Gravatar, and links to places like our Discord server. Their own terms apply, and we're not responsible for their services or content.

XIV.Disclaimers

TO THE FULLEST EXTENT ALLOWED BY LAW, THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON'T PROMISE THE GAME WILL ALWAYS BE AVAILABLE, ERROR-FREE OR SECURE, OR THAT PROGRESS OR DATA WILL NEVER BE LOST.

XV.Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL OR VIRTUAL ITEMS, ARISING FROM YOUR USE OF THE GAME. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 6 MONTHS BEFORE THE CLAIM, OR (B) US $50.

Some places don't allow these limits, so they may not apply to you. Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, or anything else that can't be limited by law, and nothing removes the legal rights you have as a consumer where you live.

XVI.Your responsibility

To the extent the law allows, you agree to cover our reasonable costs and losses from claims made by others because you broke these Terms or the law, or because of content you posted.

XVII.Ending this agreement

You can stop playing and delete your account any time in Settings → Danger Zone → Delete Account. We may end these Terms or your access as described in section IX, or if we close the Game. Sections that by their nature should continue (such as ownership, disclaimers, limitation of liability and disputes) still apply afterwards.

XVIII.Disputes and governing law

Talk to us first. Most problems can be fixed quickly. Before starting any legal claim, please email support@legaryn.com with a short description and give us 30 days to try to resolve it.

Governing law. These Terms are governed by the laws of the State of North Carolina, USA, and applicable US federal law, without regard to conflict-of-law rules. Any claim that isn't resolved informally will be heard in the state or federal courts located in North Carolina, and you and we agree to those courts' jurisdiction. If you live in the EU, UK or another country with mandatory consumer protection laws, you keep those protections and may bring a claim in the courts where you live. Either side may take a qualifying claim to small claims court.

XIX.Apple App Store terms

If you downloaded the Game from the Apple App Store:

• These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the Game and its content.
• Your license is limited to using the Game on Apple-branded devices you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions. Accounts may also be used through Family Sharing where it's supported.
• Apple has no obligation to provide maintenance or support for the Game.
• If the Game fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the fullest extent the law allows, Apple has no other warranty obligation for the Game.
• We, not Apple, are responsible for handling any claims about the Game, including product liability claims, claims that it fails to meet legal or regulatory requirements, and consumer protection or privacy claims.
• If anyone claims the Game or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
• You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
• You must follow any applicable third-party terms when using the Game, such as your mobile carrier's terms.
• Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept them, Apple has the right to enforce them against you.

XX.Google Play terms

If you downloaded the Game from Google Play, the Google Play Terms of Service also apply to your purchases. Google is not a party to these Terms and is not responsible for the Game.

XXI.Changes to these terms

We may update these Terms from time to time. We'll change the date at the top and, for important changes, tell you in the Game before they take effect. If you keep playing after that, you accept the new Terms. If you don't agree, you can stop playing and delete your account.

XXII.General

• These Terms and the Privacy Policy are the whole agreement between you and us about the Game.
• If any part is found unenforceable, the rest still applies.
• If we don't enforce a right straight away, we haven't given it up.
• You can't transfer your rights under these Terms. We may transfer ours, for example if the Game or Legaryn LLC is sold or merged.
• We're not responsible for delays or failures caused by things outside our reasonable control.
